Massachusetts Pay Transparency Obligations Take Effect

Massachusetts employers with twenty-five or more employees are now required to be in compliance with the Commonwealth’s new Pay Transparency Act.

Among other things, effective October 29, 2025, covered employers must:
 

  • Establish salary ranges for each position within the organization.

  • Include salary range information on every new and active job posting (whether internal or external).

  • Provide salary range information to employees who are offered a promotion or a transfer to a new position.

  • Upon request, provide salary range information to an applicant for the position sought.

  • Upon request, provide salary range information to employees for their current positions.

Because the Commonwealth’s new pay transparency obligations represent a major shift from how many employers have traditionally approached salary-related inquiries, employers should ensure that all hiring managers and HR personnel understand the new requirements.
