Firm Successfully Obtains Dismissal of Claims
The Firm successfully obtained dismissal of one corporate Defendant, TD Banknorth Inc., and the dismissal of three Counts of Plaintiff’s Complaint against another corporate Defendant, TD Banknorth Insurance Agency, Inc. in the matter of Kathleen Sousa v. TD Banknorth Inc., et al., Civ. Case No. 1:05-CV-421 (United States District Court District of New Hampshire). Following the filing of Defendants’ Motions to Dismiss, Plaintiff conceded the dismissal of TD Banknorth Inc. as well as her claims for intentional infliction of emotional distress and wrongful termination against TD Banknorth Insurance Agency, Inc. The Court dismissed the third claim against TD Banknorth Insurance Agency, Inc. for breach of the implied duty of good faith and fair dealing because Plaintiff had not demonstrated that Defendant terminated her employment “in order to deprive her of compensation she had already earned.”
