Massachusetts Lawyers Weekly
William E. Hannum III was quoted in an article entitled 'Amendment Could Herald Additional Arbitration Reform' in the March 1, 2010 issue of Massachusetts Lawyers Weekly. The amendment prohibits defense contractors from forcing employees to arbitrate claims under Title VII, which bans employment discrimination based on race, color, gender or national origin. Though the law may only apply to contractors who receive payments from the 2010 defense appropriations bill, the fallout could be far broader. Will warns that given the potential for sweeping reforms in the future, employers may want to take a hard look at their present practices. 'If they have systems in place that rely on [arbitration clauses], they may want to think about where they are going in six, 12 or 18 months.'

First, we will focus on bullying—defining it, considering how to prevent bullying in schools, best practices for responding to complaints of bullying, and developing and enforcing policies with respect to bullying and hazing. The second half will focus on tips and traps in interviewing, hiring, discipline, and discharge of employees, including identification of the essential components of a job description, drafting a legally compliant employment application, interviewing and selecting candidates (what you can and cannot ask), using reference checks to your advantage, carefully conveying the offer and a rejection, and best practices for the discharge process.

This interactive presentation will offer an opportunity to address employment law issues that often challenge the Business Office. First, we will focus on tips, traps, checklists and best practices for employing faculty in today's environment, and will include discussion of topics such as: critical components of a faculty employment offer and a renewal, how to incorporate contingencies into employment offers, incorporating School policies and protocols, pay structures during the academic year v. the calendar year, and weighing the pros and cons of having a contract for employment. The second half will highlight the top ten policies that limit a school's liability and legal exposure. Discussion will include the ten "must have" policies, as well as practical tips for drafting and implementation, compliance with the Family and Medical Leave Act, and whistleblower, bullying, hazing, and harassment policies.
