Sara Goldsmith Schwartz and William Hannum III presented an interactive two-part presentation addressing many issues of significance to independent schools.

The first session, "Critical Employment Policies: The Top Ten Policies That Limit A School's Liability and Exposure," offered "best practices" policies and included discussion of topics such as:

  • The ten "must have" policies, as well as practical tips for drafting and implementation;
  • Compliance with the Family and Medical Leave Act, including the new military leave requirements and the myriad complex overlaps with state leave laws, workers' compensation statutes and disability discrimination laws;
  • Whistleblower policies; and
  • Record retention protocols (including written checklists)
The second session, "Wage and Hour Compliance: How to Conduct a Self-Audit Before the Government Audits You," provided user-friendly checklists and addressed common traps and challenging quagmires in the wage and hour laws, providing practical compliance strategies on topics such as:

  • The recently amended independent contractor law;
  • Proper classification of exempt and non-exempt employees;
  • Overtime challenges;
  • Meal and break requirements and waivers;
  • Deductions from pay for housing and meals;
  • Employment of minors;
  • Compensatory time;
  • Reporting pay; and
  • Explanation of treble damages

They also explored the tools and strategies these executives used to empower themselves in overcoming familiar and challenging business obstacles. G. Michael Palladino presented Reducing The Legal Risks Associated With A Reduction in Force. During hard economic times, employers are often required to make difficult downsizing decisions to cut costs. However, by not handling a reduction in force carefully, regardless of the number of employees involved, a company can significantly increase its exposure to potential legal claims by former employees. Mike Palladino provided practical tips for shrinking the workforce without expanding employee claims. Topics included proper preparation of severance agreements, analysis of disparate impact issues, and reduction-in-force justification statements. This presentation was held at The Gloucester House Restaurant, 37 Rogers Street, Gloucester, MA from 7:30 am - 9:00 am.
