Employment Law For The Business Office: Tips, Traps and Best Practices

This interactive presentation offered an opportunity to address employment law issues that often challenge the Business Office. First, we focused on bullying—defining it, considering how to prevent bullying in schools, best practices for responding to complaints of bullying, and developing and enforcing policies with respect to bullying and hazing. The second half focused on tips and traps in interviewing, hiring, discipline, and discharge of employees, including identification of the essential components of a job description, drafting a legally compliant employment application, interviewing and selecting candidates (what you can and cannot ask), using reference checks to your advantage, carefully conveying the offer and a rejection, and best practices for the discharge process.

This interactive presentation offered an opportunity to address employment law issues that often challenge the Business Office. First, we focused on tips, traps, checklists and best practices for employing faculty in today's environment, and included discussion of topics such as: critical components of a faculty employment offer and a renewal, how to incorporate contingencies into employment offers, incorporating School policies and protocols, pay structures during the academic year v. the calendar year, and weighing the pros and cons of having a contract for employment. The second half highlighted the top ten policies that limit a school's liability and legal exposure. Discussion included the ten 'must have' policies, as well as practical tips for drafting and implementation, compliance with the Family and Medical Leave Act, and whistleblower, bullying, hazing, and harassment policies.

The program explained compliance measures employers should take and gave a roadmap for compliance steps, including a Written Information Security Program (WISP).

Health Law Reform Overview

MCLE Webcast and On-Site Program

At this MCLE Webcast and on-site program, the panelists including William E. Hannum III provided an overview of the new federal Patient Protection and Affordable Care Act, amended by the Health Care and Education Affordability Reconciliation Act of 2010 (the 'Health Care Reform Act'). Will's presentation explored how the Health Care Reform Act will impact Massachusetts employers and their group health plans and address, among other topics, the employer contribution mandate, automatic enrollment, subsidies for small employers and the requirement to provide rest breaks and space for nursing mothers.
