This webinar will provide an overview of the required compliance measures and offer a road map for compliance steps before and after a data security breach, pursuant to the Massachusetts data security law as well as other states’ data security laws. The webinar will also address the Red Flags Rule, the federal identity-theft law that went into effect on January 1, 2011. The Rule requires covered entities to implement a written program that describes the entity’s policies and procedures for detecting and preventing identity theft. The seminar will focus on defining covered entities and outlining compliance obligations. Most independent schools are covered by this law and must implement the required program.

The recent front page news events at Penn State have educational institutions of all sizes taking notice. Facing the domino effect of the Penn State revelations, schools are now revisiting their policies and procedures, reconsidering how they investigate and report crimes and other abuses that may have occurred on campus. This roundtable discussion, facilitated by Sara Schwartz, focused on these challenging issues facing independent schools. We addressed how you can prepare your community to be in compliance -- and how to be ready to "do the right thing." We addressed best practices for preventing sexual abuse on campus and responding to current and former students who raise allegations. We also discussed investigation tips and traps and related issues such as external and internal communications strategies, in this lively, interactive roundtable discussion.

Are You Properly Classifying Independent Contractors, Temps, Interns and Volunteers

Among other law enforcement agencies, the Department of Labor is actively enforcing wage and hour laws against employers that have misclassified employees as independent contractors, temps, interns or volunteers. Misclassification can lead to significant liability in unpaid wages, benefits, and employment taxes. Independent contractor agreements are under increasing scrutiny, as are long-term temporary employees (what benefits do they get?); interns (do they get paid?); and volunteers (can your employees "volunteer"?). Federal and state governmental agencies - and plaintiffs' attorneys - are increasingly interested in these issues. During this session, attendees learned about the appropriate tests for determining the proper classification of all these types of workers.
