Heads Up, Employers: A New I-9 Form Is Now Available

On January 31, 2020, the U.S. Citizenship and Immigration Services issued a new version of Form I-9, which employers are required to use to verify the identity and employment authorization of each new hire.

The new version of the I-9, dated 10/21/2019 in the lower left corner of the form, contains only minor changes from its predecessor (dated 07/17/2017). Apart from two newly renamed countries included in the drop-down menu for the electronic version, the only changes to the I-9 are in the instructions section. In particular, the instructions now clarify that (1) an employer may designate anyone as its authorized representative for purposes of completing the form, and (2) a worker's Employment Authorization Document containing a photograph is a List A (rather than a List C) document.

Employers may begin using the new I-9 form immediately, and must begin doing so by no later than May 1, 2020.
